Suspect in boy's death could face death penalty

SILVER SPRINGS, Nev. (KOLO) - A Silver Springs man accused of killing his girlfriend's 2-year-old son could face the death penalty. 23-year-old Cody Wallace has been in Lyon County Jail since his arrest on November 28th. His first court appearance was scheduled for Thursday morning in Walker River Justice Court. Instead of entering a plea, he signed a 15-day waiver postponing his status hearing. That gives the D.A. time to consider whether the death penalty is warranted in this case.

Wallace is accused of causing severe injury to 2-year-old Thomas O’Connell IV, leading to his death. According to authorities, Wallace had been alone with the victim, when he called 911 to report that the boy had stopped breathing. Thomas was taken to a Reno trauma center for treatment, but later died. In addition to first degree murder, Wallace also faces charges of child abuse, neglect or endangerment. He remains in jail without bail, and is expected back in court on December 30th.
