Trial Continuing in Hep-C Case

LAS VEGAS (AP) - Trial is continuing in Nevada state court after a failed bid for a mistrial by the lawyer for the former physician-owner a medical clinic accused of infecting patients with hepatitis C in 2007.

Clark County District Court Judge Valerie Adair ruled Tuesday that a prosecutor did commit misconduct when he asked a witness about federal charges pending against the former doctor, Dipak Desai.

But the Las Vegas Review-Journal reports the judge said she believes Desai and former nurse anesthetist Ronald Lakeman can still get a fair trial.

Desai lawyer Richard Wright argued the question that prosecutor Michael Staudaher asked Monday of former Desai clinic manager Tonya Rushing prejudiced Desai in front of the jury.

Testimony began May 6 and is expected to take several more weeks.
