Third Test: Fatal Bus Stop Crash Driver Was Drunk

LAS VEGAS (AP) - Prosecutors say a third blood test shows a 23-year-old driver had a blood-alcohol level of 0.087 percent when he plowed a car into a crowded Las Vegas bus stop, killing four people.

Deputy Clark County District Attorney Eric Bauman tells The Associated Press that tests show Gary Lee Hosey Jr.'s blood-alcohol level was above the Nevada legal limit of 0.08 percent 45 minutes after the crash.

Hosey was one of eight people hurt in the Sept. 13 wreck.

He's now jailed, facing felony charges that could put him in prison for the rest of his life.

Tests on other blood samples were 0.063 percent two hours after the crash, and 0.054 percent three hours later.

Hosey's lawyers are questioning the testing procedure and the results.
