LAS VEGAS (AP) - A 42-year-old man accused of killing a patron and wounding two employees at an after-hours Las Vegas Strip casino nightclub has been indicted on charges that could get him the death penalty.

A Clark County District Court grand jury on Friday added two counts of battery with a weapon causing substantial bodily harm to the murder, attempted murder and weapon charges previously filed against Benjamin Frazier.

Prosecutor Giancarlo Pesci says the new charges give a jury the choice to decide if Frazier intended to kill the two Drai's security guards he's accused of wounding Oct. 21 at Bally's hotel-casino.

Police say the patron, Kenneth Brown, was shot twice and died after tackling Frazier.

Frazier's arraignment is Dec. 4 in state court.

His lawyer, Bob Beckett, didn't immediately respond to messages.
