LAS VEGAS (AP) - A grand jury in Nevada has indicted a 29-year-old man on charges that could get him the death penalty in a Las Vegas Strip crash that killed an off-duty California Highway Patrol officer and the officer's relative.
The 10-count indictment filed Friday accuses James Robert Montgomery of two counts each of murder and kidnapping in the August crash that killed Officer Jesus Magdaleno Jr. and his brother-in-law, Felix Brandon Cruz III.
Montgomery is accused of stealing the officer's truck from a casino valet stand and crashing it with the two men in the cargo bed.
Montgomery, of Tustin, Calif., previously pleaded not guilty to all charges. They also include robbery, burglary and auto theft.
He's being held without bail at the Clark County jail. His arraignment is Nov. 25.
