BIRMINGHAM, Ala. (AP) - An Alabama appeals court is refusing to block an order requiring a man to remove the body of his late wife from a grave in his front yard.
The Alabama Court of Civil Appeals denied the request by homeowner James Davis of Stevenson. He buried his wife outside their home in 2009, and the city is trying to make him move the grave.
The court Monday also refused to lower a $10,000 bond that another judge set as a condition for stopping the removal of Patsy Davis' body. Davis says he doesn't have the money.
Court clerk John Wilkerson said Tuesday the man could still pay the bond, and the city could decide against pushing for removal of the body.
A city attorney didn't return a message seeking comment.
