SAN JOSE, Calif. (AP) - Drug pilfering charges won't be filed against a California jailhouse nurse, but a second nurse has pleaded guilty to narcotics possession.
Investigators arrested 50-year-old Elmer Alegado and 54-year-old Rodolfo Idian in November for stealing prescription drugs intended for the medical care of inmates at the Santa Clara County Jail.
Their lawyer says the nurses were simply careless in keeping track of the drugs.
The San Jose Mercury News says Santa Clara County prosecutors have now decided not to file charges against Idian.
Alegado pleaded guilty to narcotics possession in exchange for dropping a more severe embezzlement charge.
If he completes a drug-diversion program, the charge will be cleared from his record because it was his first criminal offense.
