SAN PABLO, Calif. (AP) - Prosecutors say they will not charge a man accused by a Northern California city councilman of knocking him out and later dumping him at a horse racing track.

The Contra Costa Times reports (bit.ly/NT9DIj) that there was insufficient evidence to charge 55-year-old Albert Beal with battery.

Beal had given a different account of what happened in July when San Pablo City Councilman Paul Morris said a man punched him at a property he manages in nearby Richmond. Morris said he passed out and when he woke up later he found himself inside his car at Golden Gate Fields.

Beal said he rescued Morris from an attack by two men who chased him from a motel.

Morris has been a councilman in San Pablo since 2002.
