SACRAMENTO, Calif. (AP) - A Northern California man who spent 3 1/2 years in jail in the death of his 4-month-old son has walked free after a judge dismissed the case because of insufficient evidence.
The Sacramento Bee reports prosecutors sought the dismissal of murder charges against 24-year-old Everett Bobbylee Quinn when two doctors whose medical opinions led to the murder charges changed their minds.
The physician who initially examined the child determined he died from traumatic abuse in May 2009. But asked to review his records by defense attorneys, the doctor changed his opinion.
Another doctor testified the boy's injuries most likely occurred two to three weeks before he was taken to the hospital.
Quinn could not be reached Thursday, and his attorney declined to comment.
