Owners Of Modesto Pot Shop Guilty Of Criminal Enterprise

FRESNO, Calif. (AP) - A federal jury has convicted two Modesto men of running a criminal enterprise in connection with a medical marijuana dispensary they operated in the city.

Luke Scarmazzo and Ricardo Ruiz Montes - both 27 years old - are
facing at least 20 years in federal prison for manufacturing marijuana and distributing the drug, as well as operating a continuing criminal enterprise.

Prosecutors says their medical marijuana dispensary made more
than $4.5 million in pot sales from October 2004 to June 2006.

The two are scheduled to appear in court May 27 for a hearing in which the government will decide whether to retry them on a conspiracy charge.

Scarmazzo's attorney calls the verdict was "an unfair prosecution" of two people who never intended to break the law.
