SAN JOSE, Calif. (AP) - DNA evidence has cleared a Mexican immigrant who was jailed on rape charges for more than three months.
Santa Clara County prosecutors on Friday dismissed all charges
against 42-year-old Cesar Augusto Alvarez.
He was arrested three days before Christmas and charged with felony forcible rape after the alleged victim identified him.
Alvarez was in the country illegally and authorities are preparing to deport him.
His lawyer says Alvarez feels "great relief" that he's been cleared of the rape charges. He doesn't want to be deported, but looks forward to seeing his wife and children back in Mexico.
