The San Diego County district attorney's has cleared an Oceanside police officer of any criminal liability in the fatal shooting of a man driving a stolen car.
Motorcycle officer Clint Bussey killed 23-year-old Josue Narvaez Garcia after following the car to an apartment complex in Vista on August 30, 2006.
Bussey told investigators that he fired shots as Garcia backed up and swerved toward him. The car hit a support beam, and the officer told Garcia to raise his hands. Instead, Garcia reached down with both hands.
Bussey said he fired seven more shots because he thought Garcia
might be reaching for a weapon.
District Attorney Bonnie Dumanis said Bussey acted properly in self-defense.
