A jury has deadlocked on whether to recommend the death penalty or a life in prison sentence for a gang leader convicted of murdering three people.
The Los Angeles Superior jury said Friday it could not reach an unanimous decision on the fate of Timothy McGhee, prompting a judge
to declare a mistrial in the penalty phase of the case.
The same jury had convicted McGhee last month of first-degree murder in the 1997 shooting of a rival gang member, and the attempted murder of four others.
Prosecutors said they have not decided whether to retry the penalty phase with a new jury.
