DA Won't Charge Laguna Beach Cops Who Shot Couple

No criminal charges will be filed against police officers who killed a couple during a confrontation at a luxury resort, the Orange County district attorney's office said.

"The shooting of Kevin and Joni Lynn Park was reasonable under the totality of the circumstances that existed at the time," the DA's office, which investigated the shooting, said Friday in a letter to Police Chief Mike Sellers.

The two officers still face a Police Department investigation to determine whether they violated any policies, Capt. Mike Hall said.

Kevin Park, 49, and Joni Park, 48, were shot to death April 22 at the Montage Resort & Spa after officers received calls that a naked woman was threatening people with a semiautomatic handgun.

Police said they opened fire after the gun was pointed at officers.

The Parks, who owned a small real estate business, lived in Mission Viejo but used fake names and a fake address when they checked into the resort, authorities said.

Along with boxes of documents, the couple had a bagful of ammunition in their $2,200-a-night bungalow, police said.

The FBI announced in May that it had opened an investigation to determine whether the couple committed real estate fraud.
