WCSD Board Approves Settlement With Martinez

The Washoe County School Board unanimously approved a $25,000 settlement Tuesday afternoon with Superintendent Martinez to settle his lawsuit.

Martinez has ten days to decide whether to accept.


RENO, NV - During a meeting on Tuesday, Aug. 12, 2014, the Washoe County School Board of Trustees voted to retain outside legal counsel in connection with a lawsuit initiated by Superintendent Pedro Martinez against the Washoe County School District, and the board.

The allegation of Martinez's lawsuit was that the Nevada Open Meeting Law was violated by the board. Trustees had met to fire Martinez, who was rehired after the lawsuit was filed.

The Board of Trustees is authorized to “employ private legal counsel when the board determines that such employment is necessary.” (NRS 386.410)

Additionally, Board Policy 9012, Legal Counsel, directs the Chief General Counsel to bring any action that could result in fees and costs in excess of $50,000 to the attention of the Board of Trustees.

Barbara Clark, Howard Rosenberg, Barbara L. McLaury, Lisa Ruggerio and John Mayer voted in favor. Estela Gutierrez voted no.
