Toxic Mine Lawsuit Going Ahead
A trial is still more than a year away, but a federal judge in Nevada has cleared the way for neighbors of a toxic mine to go forward with a class-action lawsuit against Atlantic Richfied Co. and its parent BP.

RENO, Nev. (AP) - A trial is still more than a year away, but a
federal judge in Nevada has cleared the way for neighbors of a
toxic mine to go forward with a class-action lawsuit against
Atlantic Richfied Co. and its parent BP.
The suit seeks at least $5 million. It accuses the companies of
intentionally and negligently concealing the extent of pollution at
the old Anaconda copper mine near Yerington, where a plume of
contaminated groundwater has been migrating off the site for
decades.
Judge Robert Jones ruled Monday the plaintiffs cannot seek
damages under the theory of "unjust enrichment." But they are
free to try to prove the companies are guilty of negligence and
trespassing by allowing uranium and other contaminants into private
wells.
He set the trial June 18, 2013.
