Appeals Court Puts Nevada Gay Marriage on Calendar

CARSON CITY, Nev. (AP) - A federal appeals court says it will consider Nevada's gay marriage ban in September.

No firm date for oral arguments was set by the 9th Circuit Court of Appeals in San Francisco in an order last week that added the case to its September calendar.

Eight same-sex couples argue that a voter approved 2002 law defining marriage as between a man and a woman is unconstitutional.

A federal judge in Reno upheld the law in 2012, sending it to the appeals court. In February, state lawyers withdrew their defense of the law, leaving the Coalition for the Protection of Marriage to argue it alone.

Gay marriage bans have been falling around the country since the U.S. Supreme Court last year struck down part of the federal Defense of Marriage Act.
