Reno Couple Not Charged In Death Of Infant Son

Prosecutors say charges will NOT be filed against a Reno couple arrested on suspicion of neglect in the January death of their baby.

Washoe County Deputy District Attorney Luke Prengaman says there
was not enough evidence to prove beyond a reasonable doubt that Craig and Michelle Smith caused the death of their one-month-old son, Ty.

He says the decision not to charge them does not preclude future
charges if further evidence is discovered.

The case remains under investigation by police.

A medical examiner ruled Ty died of an acute head injury that was consistent with child abuse.

Attorneys for the couple say the dismissal of the neglect charges supports their innocence and Ty's death was a "tragic loss" for them.

The Smiths were arrested in June on charges of child neglect causing death.

Craig Smith owns a window-fashions business, while his wife is a
former Reno High School math teacher who gave up her career to be a
stay-at-home mother.
