Citizens along with John Ascuaga’s Nugget have filed a lawsuit in district court against the City of Sparks and Red Hawk Land Company in opposition to the settlement agreement reached in the proposed Lazy 8 casino project.
Stephen Peek, legal counsel for the plaintiffs, says that the lawsuit seeks no monetary damages, rather, the action seeks independent judicial review. He continued to say that a Master Plan amendment is required to approve the Lazy 8 project.
Specifically, as detailed in the lawsuit, today’s action asks the court to declare the settlement void and reinstate the August 24, 2006, decision of the Sparks City Council.
