HAMILTON, Ohio (AP) - A judge says he will release a man who was jailed last week for failing to make sure his daughter earned her high school equivalency diploma.

Butler County Juvenile Court Judge David Niehaus's decision Friday would let Brian Gegner out of jail if his 18-year-old daughter Brittany attends a GED preparatory class and schedules the test before the next court date.

Gegner received a 180-day sentence for contributing to the unruliness or delinquency of a minor.

He had been ordered months ago to make sure his daughter, who has a history of truancy, received her GED - something that hasn't happened yet. His daughter has said it's not fair that her father was punished for her behavior.

how can he be charged with "contributing to the unruliness or delinquency of a minor" - when the daughter is 18, and NOT a minor??????

Now that is BS! His daughter in now 18, and last I knew a child could Quit school at the age of 16 without the parents permission! Even though I agree that everyone should have a high school diploma, the choice is the individules after they turn 16!!! So therefore the father shouldn't be in jail or have charges against him at all!!! Also where is the mother, why wasn't she charged as well, if they were going to charge the father anyway???

Ludicrous! Whatever happened to our justice system?

There are better way's to deal with the child and not hurt the father, even at 16 the daughter is old enough to understand what she was doing and be punshed for it

I think that it is not fair that a parent has to pay for their child's behavior. I as a parent try to make my children follow not only my rules but also societies rules. And it doesn't always work out that way. My kids like to be truant after I leave to work, and than I dont know about it for days that they were. I will not pay for their careless actions.
