It began with an innocent sleep over party at a former teacher’s home, but some say it ended in an alcohol-fueled assault on an under-aged girl. Now it has a rural town wondering what should happen next.

Fallon Police are trying to determine what happened at a party owned by a former coach at Churchill County High School on January 18th. According to reports, it was to be an all girls sleep over. Parents say they were assured there would be no boys and no alcohol.

However, there was alcohol and according to some it was provided by the owner of the home. Also, boys ended up at the home. Sometime during the evening, it's alleged, a very inebriated 15 year old freshman girl had sex with 4 of the boys. Three of them are 17 year olds. The fourth, a son of a prominent family with ties to the local legal community, is 18.

We're told the girl had attended a Christian Academy until the past year or so. She was not very worldly and one might imagine she was vulnerable. She's been moved out of state after apparently being harassed at school and is reportedly terrified at the thought of returning.

The 18 year old is an athlete at Churchill County High. His page on My Space contains an argument that baseball players are different from other athletes because they can drink the night before and still play their best and get the women.

The owner of the home is a former coach at Churchill County High School. She left last spring. The school district could only say there were circumstances leading to her departure.

As for charges, the girl is 15 and one boy is 18. If the investigation leads to charges he could face felony statutory rape charges. The 17 year olds presumably would be tried as juveniles.
If she furnished the alcohol, the former coach could be looking at contributing to the delinquency of a minor certainly, but more serious, if there are felony rape charges, potentially she could be prosecuted as an accessory. There is one other detail that troubles many. Reportedly this incident was widely known at school for 5 days before it was reported. If any staff member at the school knew of the event and didn't report it as required by law, that's a potential violation.

The story is only now breaking amid statements the rape was not reported until 5 days later when the girl reported being harassed at school. She and others in this town fear the investigation will be hampered because of the family of the 18 year old boy. Her attorney, a former Churchill County District Attorney, is conducting his own investigation and preparing civil action.

Fallon's mayor took the unusual step of issuing a press release assuring the community police were actively pursuing the case. He did so with an eye on rumors circulating around town and the fact that Fallon is currently without a police chief. Although he says his police department is conducting an intensive investigation, he wants at some point to bring in an independent agency to ensure the investigation is thorough and unbiased..

okay were are people getting that the "victim" was passed out from?? she was fully aware of what she was doing... she was up walking around doing cheer leading moves.. too bad no one saw the actual videos,,, she was sure awake in them...

For all of you who think that the good ole boys have won, I guess you are wrong since the D.A. sent the case to the Attorney General. Until the victim left the Christian School my children went to school with the victim and have spoken to her since that horrible night. Whether she was drinking or not does not give anyone the right to take advantage of her. She is one of the most honest, caring, kind, and smart child that I have ever met. I also know the defendents family and know that they are wonderful parents. They are good role models and love their children. Parents can talk to kids and teach the right from wrong but children do make mistakes. I feel for both families and hope this all gets over quickly. I am also so proud of the D.A. to realize that it would be in his best interest not to handle this case. Except as otherwise provided in this section, a person who: (a) Knowingly serves, sells or otherwise furnishes an alcoholic beverage to an underage person; or (b) Knowingly allows an underage person to consume an alcoholic beverage on premises or in a conveyance belonging to the person or over which he has control, Ê is liable in a civil action for any damages caused by the underage person as a result of the consumption of the alcoholic beverage. 3. The liability created pursuant to subsection 2 does not apply to a person who is licensed to serve, sell or furnish alcoholic beverages or to a person who is an employee or agent of such a person for any ... 4. A person who prevails in an action brought pursuant to subsection 2 may recover his actual damages, attorney’s fees and costs and any punitive damages that the facts may warrant. 5. As used in this section, “underage person” means a person who is less than 21 years of age.
