First Lawsuit Filed in Fernley Flooding Disaster

Just five days after waters rushed through a collapsed irrigation canal levee, flooding hundreds of homes in Fernley, the first lawsuits has been filed.

The suit was filed on behalf of Fernley homeowner Judy Kroshus in the second Judicial District Court in Washoe County. The complaint targets the following: Truckee Carson Irrigation District, the City of Fernley, Lyon County and the developers and real estate agents involved in building homes on the flooded land.

Among many claims, the suit alleges that the town of Fernley and the county encouraged growth in an area that the agencies knew was at risk of flooding. It also blames the developer and real estate agents failed to disclose the potentional danger.

The suit asks for unspecified general and punitive damages. It is expected that other residents will join this legal action which would amount to a class-action lawsuit.
