Former Music Teacher Takes Plea Deal in Las Vegas Lewdness Case

A former Las Vegas elementary school music teacher who was accused of fondling three female students is taking a plea deal that could get him probation.

Don Kevin Smith's lawyer told a judge Smith will plead the equivalent of no contest to attempted lewdness with a minor under 14.

That's a felony that carries a possible sentence of two to 20 years in prison.

The judge scheduled Smith to enter his plea December fifth in Clark County District Court.

A prosecutor says the deal avoids testimony from the girls and ensures that Smith can't teach again.

Smith taught at Tate Elementary School before he was charged with two counts of lewdness with a minor under 14.
