LAS VEGAS (AP) - A man was bound over Tuesday for trial on a
felony charge of possessing a videotape showing a little girl being
Darrin Tuck, 27, of Pahrump, could face one to six years in state prison if convicted of possession of child pornography, said his lawyer, Chris Rasmussen, who criticized Nye County District Attorney Bob Beckett for charging Tuck with a crime.
"You cooperate with the Nye County justice system and you end up in jail," Rasmussen said. "That's the message they sent today."
After Tuck gave the tape to Nye County sheriff's deputies and told them he found it in the desert, Sheriff Tony DeMeo circulated the girl's photo to identify her and the man shown assaulting her.
The girl, now 7, was found safe Sept. 28 in Las Vegas. Her mother said she believed the girl was not yet 3 years old when the attack occurred.
Chester Arthur Stiles, 37, the man identified on the tape, became the focus of a nationwide manhunt before he was arrested October 15 in a routine traffic stop in Henderson.
Stiles faces 23 felony charges, including lewdness with a child under 14 and sexual assault of a child under 14. Three charges are related to a separate alleged molestation of a 6-year-old girl in December 2003.
Beckett alleged Tuesday that Tuck kept the video for several months and showed it to at least one other person before turning it over to detectives.
"We don't believe we have the entire story yet," Beckett said.
A friend of Tuck's, James Childs of Pahrump, testified that Tuck told him in May that he found the videotape, Beckett said.
Pahrump Justice of the Peace Tina Brisebill threw out a defense subpoena seeking to compel DeMeo to testify about allegations linking Stiles and Tuck. The judge ruled that the document was improperly filled out, Rasmussen and Beckett said.
Tuck's arraignment was set Dec. 3 in Nye County District Court. Rasmussen said he will plead not guilty and fight the child pornography charge.
Tuck remains jailed in Pahrump on a five-month sentence for violating probation by failing to pay child support.
Pahrump is a Nye County town about 60 miles from Las Vegas.
