No Appeal of Dismissed Conviction in MySpace Case
Federal prosecutors will not appeal a judge's dismissal of a Missouri mother's convictions for her role in a MySpace hoax directed at a 13-year-old girl who committed suicide.

LOS ANGELES (AP) - Federal prosecutors will not appeal a judge's dismissal of a Missouri mother's convictions for her role in a MySpace hoax directed at a 13-year-old girl who committed suicide.

U.S. attorney's office spokesman Thom Mrozek said Friday that prosecutors had filed a notice of appeal to protect their right to continue pursuing the case against Lori Drew, but after a review decided against an appeal.

The move effectively ends the case.

Los Angeles federal Judge George Wu threw out Drew's multiple misdemeanor convictions in July, citing the vague computer fraud statutes that led to her conviction.

The case was discussed as an unprecedented prosecution of cyberbullying, but the judge wrote that it was never a legal test of such crimes.
